Murder (Homicide) Defined

Murder (criminal Homicide) is an act that results in the death of another human being. Homicide can be caused by intentional, unintentional, premeditated, reckless, or even careless actions. With a proper defense, however, homicide in some instances is not always considered a criminal act.

Types of Murder:

There are several types of homicide in California:

  • 1st Degree Murder – A homicide committed with specific intent and with premeditation or malice aforethought.
  • Voluntary Manslaughter – The intentional killing of a person when the defendant had no prior intent to kill.
  • Involuntary Manslaughter – The unintentional killing of a person.
  • Vehicular Manslaughter – The unintentional killing of a person as the result of reckless driving, such as a DUI.
