Elements of the Crime

For a prosecutor to convict you for speed exhibition (VC 23109(C)), the prosecutor must prove the following facts (elements of the crime) beyond reasonable doubt:

  • You drove your vehicle on a public roadway; and
  • While driving, you willfully engaged in an exhibition of speed

An “exhibition of speed” means that you drove at a rate of speed that is dangerous and unsafe in order to show off or make an impression on someone else.

But I Wasn’t Speeding

You do not actually have to violate the speed limited to be cited for speed exhibition. Conduct such as peeling out, burning out, or rapid acceleration may be sufficient to meet the elements of the offense.

Furthermore, the prosecutor does not have to prove that you engaged in conduct to show off to any particular person.

Penalties

Speed Exhibition is a misdemeanor and carries with it a maximum sentence of up to 90 days in county jail and a five hundred dollar ($500) fine, or both. If convicted, you also will receive two points on your DMV driving record.
